جهانی شدن حقوق و به زیر کشیدن لیبرال دمکراسی

قانون به عنوان یک رشته به سرعت در حال جهانی شدن است و بسیاری از وکلا، قضات و رهبران سیاسی درگیر یک فرآیند تطبیقی «اقتباس» هستند. اما این شکل جدید جهانی سازی حقوقی دارای جنبه های تاریکی است: زیرا اقتباس، فقط منبع الهام افرادی نیست که به دنبال تقویت و بهبود نهادها و سیاست های دمکراتیک هستند. این شکل از جهانی شدن و اقتباس اساسی به طور فزاینده ای الهام بخش و مشروعیت بخش برای کسانی است که به دنبال فرار از دمکراسی در خفا، تحت عنوان نوعی پوشش لیبرال دمکراتیک مصنوعی هستند.

کتاب اقتباس اساسی جهانی شدن حقوق و به زیر کشیدن لیبرال دمکراسی، این پدیده را شرح می دهد، چگونگی موفق شدن آن و آنچه را که می توانیم برای جلوگیری از نتایجش انجام دهیم را شرح می‌دهد.

این کتاب الگوهای فعلی بازسازی سنگرهای دمکراتیک را توضیح می‌دهد و به بررسی شیوه‌های مختلف استفاده ناصواب از اساسی گرایی می‌پردزاد؛ و انواع مختلف و فنآوری‌هایی که به مشروع سازی نقش ایدئولوژی که به حمایت از حالت‌ها استفاده ناصواب از اساسی گرایی شرح می‌دهد.

این کتاب سهم مهمی در تحقیق و پژوهش حقوقی و سیاسی دارد و مورد توجه همه کسانی است که در رشته های حقوقی و سیاسی، حقوق عمومی، نظریه قانون اساسی، نظریه سیاسی و علوم سیاسی تحقیق می کنند.

 

تازه های بین المللی حقوق اساسی دهم مهر 1397-Constitutional News in Persian

1) علی رغم امیدواری فعالان حقوق حیوانات، دیوان قانون اساسی جمهوری کلمبیا قانونی بودن گاوبازی(مبارزه و کشتن گاو نر) را تأیید کرد.

The Constitutional Court of Columbia upheld the legality of bullfighting and thus dashed the hopes of animal rights activists.

2) دیوان قانون اساسی جمهوری آفریقای جنوبی استفاده خصوصی از ماریجوانا را قانونی اعلام کرد.

The Constitutional Court of South Africa legalized the private use of marijuana.

3) با رای دیوان قانون اساسی جمهوری ترکیه، پذیرش شغل کارگران جنسی به عنوان حرفه، علیه کرامت انسانی شناخته شد. در این دعوی، یک زن علیه عدم پذیرش خود در کارگاهی که مشغول به کار است شکایت کرده بود.

The Constitutional Court of Turkey held that taking up prostitution as a profession is against human dignity in a case where a woman had challenged a brothel’s decision not to admit her.

4) دیوان قانون اساسی رومانی تصویب کرد که همه پرسی ای را برگزار کند که با تعریف مجدد عنوان خانواده در قانون اساسی، قانونی شدن ازدواج انسانهای همجنسگرا را دشوارتر می کند.

The Constitutional Court of Romania gave the approval to conduct a referendum that may render same-sex marriages illegal by redefining ‘family’ under the Constitution.

5) نمایندگان مجلس عوام کانادا نتایج تحقیقات سازمان ملل متحد در میانمار را به رای گذاشتند و به اتفاق آرا قطعنامه ای را به تصویب رساندند که طی آن اقدامات نظامی دولت میانمار علیه اقلیت روهینگیا «نسل‌کشی» ارزیابی شده است.

6) دومین کانتون سوییس رای به ممنوعیت برقع داد؛ سنت گالن که در شمال شرقی سوئیس واقع شده دومین کانتون سوئیس است که این طرح در آن به تصویب می‌رسد. در رای‌گیری این طرح ۳۶ درصد از واجدین شرایط شرکت در انتخابات حضور یافتند و ۶۷ درصد آنان به این طرح رای موافق دادند.

7) تنها چند روز مانده به همه پرسی در رومانی برای ممنوعیت ازدواج همجنسگرایان، دیوان عالی این کشور در رایی تصریح کرد که زوج های هم جنس دارای حقوق برابر یکسان برای زندگی خصوصی و تشکیل خانواده همانند زوج زوج های دگرجنس گرا هستند. همه پرسی برای ممنوعیت ازدواج این اشخاص در تاریخ 6-7 اکتبر برگزار می شود.

The Supreme Court of Romania ruled that same-sex couples have the same equal rights to a private and family life as heterosexual couples, only a week before a referendum on prohibiting same-sex marriage is due to be held n October 6-7.

تازه های بین المللی حقوق اساسی بیستم شهریور 1397- News in Public Law

1) دیوان قانون اساسی جمهوری فدرال آلمان، در دستوری که به تازگی صادر کرده است اعلام کرد، در هنگام انتقال قسمت هایی از قدرت حاکمیت به سازمان های بین المللی و یا فراملی باید حفاظت موثری از حقوق بنیادین مندرج در قانون اساسی، صورت پذیرد. در این دستور که به رد درخواست رسیدگی مربوط به مدارس بین المللی فرانکفورت است، همچنین درخواست رسیدگی به نقض قانون اساسی بدلیل نبود مستندات کافی، رد شده است.

The German Federal Constitutional Court held that the core contents of fundamental rights must be guaranteed when transferring sovereign powers to international organizations.

2) با اکثریت چهار بر یک، دیوان عالی بریتانیا حقوق مربوط به زوج های ازدواج نکرده را افزایش داد. دیوان عالی با محکومیت دولت به پرداخت کمک هزینه ماهانه 117 یورو به چهار فرزند یک بیوه از زوجی ازدواج نکرده، اعلام کرده است، عدم پرداخت کمک هزینه به فرزندان زوج های ازدواج نکرده، نقض حقوق بشری مربوطه به خانواده است.

 Denying the unmarried mother of four children a widowed parent’s allowance is illegal, the supreme court has ruled, in a decision that significantly extends the rights of unmarried couples.

By a majority of four to one, the court’s justices declared the government’s refusal to pay up to £117 a week in benefits breached the family’s human rights. It will put pressure on ministers to consider making urgent changes to the law.

3) دیوان قانون اساسی نمی تواند آرای دیوان عالی را مورد بررسی قرار دهد. قضات دیوان قانون اساسی جمهوری کره با رد درخواست رسیدگی یک از فعالان سیاسی برای ابطال رای دیوان عالی مبنی بر عدم پرداخت خسارت، به این شخص، اعلام کردند دیوان قانون اساسی تنها در صورتی قادر به بررسی آرای دیوان عالی است که آرای صادره از دیوان عالی بر اساس قوانینی صادر شده باشند که پیش از این عدم تطابق آن قوانین با قانون اساسی اعلام شده باشد.

The Constitutional Court concluded, that it cannot review Supreme Court rulings, grounds under which the former is unable to nullify the latter's rulings. It also said a clause in the law on the Constitutional Court, which bans such review, is constitutional. The court dismissed a petition filed by a former pro-democracy activist to cancel a Supreme Court ruling that had not accepted his claim for state compensation.  "Court rulings can be reviewed at the Constitutional Court in very limited cases where the courts violated people's basic rights by applying laws already ruled unconstitutional by the Constitutional Court," judges said. "The petitioner's ruling, in this case, was made in accordance with the Supreme Court's interpretation, and thus is not subject to a petition to the Constitutional Court."

4) قانون حق مردانه برای رد نسبت فامیلی، مطابق قانون اساسی است. در پی تجدیدنظرخواهی زنی از دیوان عالی اوساکا مبنی بر رد حکم دادگاه بدوی با استناد به تبعیض آمیز بودن قانون حق پدر برای رد نسبیت و جاری نبودن این حق نسبت به زنان، دادگاه عالی رای پیشین را ابرام نمود. در این پرونده، زنی که بدلیل خشونت از همسر خود بصورت جداگانه زندگی میکرده است و پس از بارداری از همسر دوم و پیش از طلاق رسمی از همسر اول دارای فرزند شده است اما بر خلاف الزام قانونی، از ثبت نام فرزند در درختواره خانوادگی و اعلام آن به مقامات ثبت خودداری کرده است تا فرزند وی ملحق به شوهر سابق نگردد. حال برای برخورداری فرزند خود که اکنون 30 سال و دو فرزند دیگر دارد، از حقوق مربوطه، درخواست ابطال قانون فوق را از دادگاه درخواست کرده است.

According to the suit, the woman lived apart from her husband due to domestic violence and had a baby with a different man before their divorce was finalized. She opted not to notify authorities of the birth — required under the Civil Code — as it would have been “presumed” that the abusive husband was the biological father.

Not entering the birth in the family registry resulted in the daughter being unable to marry legally. The daughter’s two children, who were also not listed on a family registry because of her status, did not receive notifications for such things as school enrollment and public medical checkups. The daughter and her two children were able to have their names entered on a family registry in 2016 through special court procedures after the woman’s former husband died.But the plaintiffs said the three could have avoided being unregistered if wives and children were allowed to rebut presumed paternity under the Civil Code.

 5) اشخاص بومی تنها در دولت های محلی خود دارای سهمیه شغل دولتی هستند. بر اساس رای کرسی قانون اساسی در دیوان عالی جمهوری هند، این اشخاص فقط در دولتهای ایالت اصلی خود دارای فرصت شغلی رزرو شده هستند و در ایالاتی که به آنها مهاجرت کرده اند نمی توانند از این سهمیه استفاده کنند.

A Constitution bench of the Supreme Court on held that scheduled castes or tribes can avail benefit of reservation in government jobs only in their home states and can’t access quotas in other states where they might have migrated. 

6) معترضان در کمیته قضایی مجلس سنا، جلسه تایید فرد مورد نظر دونالد ترامپ برای عضویت در دیوان عالی ایالات متحده آمریکا را مختل کردند. انتخاب برت کاوانا ۵۳ ساله، گرایش دیوان عالی را بیش از پیش به سود جمهوری‌خواهان تغییر خواهد داد. معترضانی که همزمان با ورود کاوانا به جلسه فریاد می‌زدند توسط پلیس خارج شدند.

7) رودریگو دوترته رئیس جمهوری فیلیپین روز سه شنبه فرمان عفو آنتونیو تریلانز سناتور اپوزیسیون را لغو و دستور بازداشت وی را صادر کرد. آنتونیو تریلانز جدی‌ترین مخالف رودریگو دوترته است که رئیس جمهوری را به مخفی کردن ثروتش متهم کرده است. او همچنین از درخواستها برای رسیدگی به اتهام رودریگو دوترته توسط دادگاه کیفری بین المللی برای قتل مشکوک هزاران مجرم متهم به قاچاق مواد مخدر، حمایت کرده است. حکم عفو آنتونیو تریلانز به محکومیت او در سال ۲۰۱۰ میلادی باز می گردد که به خاطر نقشی که این سناتور فیلیپینی در اقدام به کودتا علیه گلوریا ارویو رئیس جمهوری پیشین داشت، مجرم شناخته شده بود. بر اساس یک اصل قانونی که روزنامه مانیلا تایمز فیلیپین که حامی رئیس جمهوری است منتشر کرده، رئیس جمهوری، عفو آنتونیو تریلانز را لغو کرده است. این روزنامه علت لغو این حکم عفو را رعایت نکردن الزامات حداقلی مانند پذیرش جرم از سوی این مخالف رئیس جمهوری عنوان کرده است. این سناتور مخالف رودریگو دوترته، حکم لغو عفو رئیس جمهوری را «احمقانه» توصیف کرده و گفته است که فرار نخواهد کرد و در برابر دستیگری‌اش مقاومت نمی کند.

وی خطاب به رسانه‌ها گفت: «این یک مورد آشکار از آزار و اذیت و ناعدالتی سیاسی است. آقای دوترته یک دیکتاتور است. او به قانون اساسی احترام نمی گذارد. برای همین ما به اینجا رسیدیم که مردم معمولی کشته و مخالفان به زندان افکنده می شوند.»

International Association of Centres for Federal Studies (IACFS)

Eligibility

Only young researchers, attached or associated with an IACFS member centre are eligible. They include full-time researchers, masters, doctoral and post-doctoral students. Former students of a centre may also apply as long as there is a demonstrable association with the member centre. The age limit is 35 years old at the time of tabling the application.

Young researchers are invited to submit a journal-length article (8 000 - 10 000 words) on a topic dealing with an aspect of federalism. The topic does not need to be linked to the theme of the IACFS annual conference. The paper must be an original work. It may have already been submitted for publication but not published. The paper must be written in English.

Process

A young researcher submits his or her work to the director of the centre and each centre may nominate up to three candidates.

Nominations and papers must be submitted to Professor Jaap de Visser ([e-mail]) no later than 30 April 2018.

Award

For 2018 the award comprises a return flight ticket to the IACFS annual conference in Canberra, Australia (25-27 October 2018), plus three days’ accommodation and a certificate. The award winner will be invited to present his/her paper at the IACFS conference. CFP
