The IGLP Scholars Workshop is an intensive, regionally-focused residential program that brings together an international cohort of young doctoral scholars, post-doctoral scholars and junior faculty for intensive collaboration, mentoring, and cross-training. Thailand Institute of Justice will take place in Bangkok, Thailand from January 6-10, 2019!

We encourage participation from scholars across Asia and worldwide who would benefit from intensive collaboration with their global peers and IGLP’s junior and senior faculty. Applications and at least one letter of recommendation must be submitted by Friday, September 21, 2018.

The 2019 ESIL Research Forum will take place on Thursday, 4 and Friday, 5 April 2019 at the Institute for International Law and European Law, Faculty of Law, University of Göttingen, Germany.

Forum invites the submission of papers addressing related issues along the following lines:

1. Roots, boundaries and interactions: conceptualizing the rule of law at international and domestic levels

2. Commitments, achievements and blind spots? - The rule of law and the United Nations

3. The rule of law in international and regional courts and tribunals: impacts, shortcomings and a “mission educatrice”?

ارزیابی فراملی یک قانون اساسی

چه کسی، چه زمانی، چگونه؟

نه تنها اغلب انواع دولت ها و روش اداره آنها متاثر از عرف های فراملی و اجبار قواعد بین المللی می باشند، بلکه قوانین اساسی نیز به عنوان شالوده حکومت قانون و شکل دهنده استقلال، تحت تاثیر  مقررات برخاسته از ابعاد افقی مفاهیم فراملی می باشند؛ با عنایت به پیشرفت های کنونی در حقوق تطبیقی معاصر، بصورت کلی، نیاز به روشی برای ارزیابی قوانین اساسی بر اساس ساختار و اصول فراملی که بتواند چارچوب نظری یک قانون اساسی را ترسیم نماید در حال شکل گیری می باشد؛ سیر قانوگذاری های اخیر قوانین اساسی در کشورهای عربی پس از آغاز بهار انسانی شروع شده در کشورهای(تونس، مصر، لیبی و ...) و تفاوت های ایشان، روندی از این نیاز  را نمودار می سازد؛ از آغاز تا پایان، نحوه ساخته شدن یک قانون اساسی، نوشتن، تصویب و اصلاح آن، جامع و مانع بودن آن چگونه می باشد؟  این موضوع در مقاله ارائه شده اینجانب در نهمین کنگره حقوق اساسی "چالش های حقوق اساسی، جهانی و محلی" که در خرداد 1393 در دانشگاه اسلو برگزار گردید، مورد بحث و بررسی قرار گرفته است. در ادامه می توانید متن اصلی این پژوهش را مطالعه نمایید.

تشکیلات سیاست خارجی اتحادیه اروپا میتواند کار خود را آغاز نماید

شورای امور عمومی اتحادیه اروپا در ۲۶ ژوئیه ۲۰۱۰ تصویب نمود که تشکیلات سیاست خارجی اتحادیه اروپا (EAD ) تاسیس گردد. پارلمان اروپا در بیستم اکتبر ۲۰۱۰ تصمیمات لازم جهت اجرائی کردن این مصوبه (انطباق موارد بودجه، نظام پرسنلی وتصویب بودجه تشکیلات EAD ) را تصویب نمود. با تائید این شورا، تشکیلات EAD میتواند از اول دسامبر سال ۲۰۱۰ کار خود را آغاز نماید.با مصوبه پارلمان اروپا آخرین موانع از سر راه تشکیلات سیاست خارجی اتحادیه اروپا (EAD ) بر داشته شده است. این خبر بسیار خوبی است زیرا از این پس سیاست خارجی اتحادیه اروپا موثرتر و یکدست‌تر خواهد گردید. این مهم بدون ایجاد تشکیلات سیاست خارجی اتحادیه اروپا (EAD ) ممکن نمیگردد.

تشکیلات EAD بر اساس قرارداد لیسبون مورخ اول دسامبر ۲۰۰۹ تاسیس میگردد. این قرارداد با ایجاد پست، نماینده عالی اتحادیه اروپا در سیاست امنیتی و خارجی و ایجاد زیر ساخت آن یعنی تشکیلات سیاست خارجی اتحادیه اروپا (EAD )، پیشرفت عمده ای در ایجاد کنشی هدفمند و یکدست برای فعالان سیاست خارجی اتحادیه اروپا را فراهم میسازد.

نماینده عالی اتحادیه اروپا در سیاست امنیتی و خارجی سه مسئولیت را بعهده خواهد گرفت که تاکنون توسط سه مقام مختلف انجام میگرفته است:- نماینده عالی اتحادیه اروپا در سیاست امنیتی و خارجی، - کمیسیار عالی سیاست خارجی اتحادیه اروپا و بلاخره - رئیس شورای سیاست خارجی اتحادیه اروپا. خانم کاترین اشتون بریتانیائی، بعنوان نماینده عالی اتحادیه اروپا در سیاست امنیتی و خارجی اتحادیه اروپا انتخاب گردیده که در عین حال یکی از نواب رئیس کمیسیون اتحادیه اروپا نیز بوده و در این مسئولیت نیزکلیه جوانب سیاست خارجی اتحادیه اروپا را هم‌آهنگ می‌نماید.

تشکیلات سیاست خارجی اتحادیه اروپا (EAD ) بر اساس قرارداد لیسبون نماینده عالی اتحادیه اروپا در سیاست امنیتی و خارجی اتحادیه اروپا را در انجام تکالیف محوله حمایت خواهد نمود.

این حمایت شامل مسئولیت در حوزه سیاست مشترک امنیتی و خارجی(GASP ) ، سیاست امنیتی و دفاعی اتحادیه اروپا( GAVP ) و تکالیف محوله در چارچوب نایب رئیس کمیسیون اتحادیه اروپا نیز میگردد.

تشکیلات EAD در راستای تکمیل خدمات دیپلماتیک کشورهای عضوء اتحادیه اروپا تاسیس گردیده و با دستگاه‌های دیپلماتیک کشورهای عضو، به همکاری خواهد پرداخت. یعنی که تشکیلات EAD جایگزین تشکیلات دیپلماتیک کشورهای عضو نگردیده بلکه مشترکاً و با قدرت بیشتر، سیاست خارجی اتحادیه اروپا را محقق میسازد.

پرسنل تشکیلات EAD نیز به همین شکل انتخاب خواهد گردید. کادر این تشکیلات شامل پرسنل منتخب از بخش‌های مسئول سیاست خارجی در دبیرخانه کل شورای اتحادیه اروپا، و کمیسیون اروپا و وزترت امور خارجه کشورهای عضو اتحادیه اروپا میباشد.
