Xiamen Academy of International Law (Xiamen Academy) is an international institution aiming to provide the highest level of legal education to individuals interested in the development and application of international law, such as young lecturers, diplomats, practitioners of law, government officials in charge of foreign affairs, and officials from international organizations. The courses are delivered in English and have been designed to be both scholarly and practical. Xiamen Academy has successfully convened and hosted thirteen summer programmes (from 2006), which featured more than ninety world-renowned international law professors, ICJ judges and experts from around the world.

آکادمی بین المللی حقوق بین الملل شیامن (Xiamen Academy) یک موسسه بین المللی با هدف ارائه بالاترین سطح آموزش حقوقی به اشخاص علاقه مند به توسعه و استفاده از حقوق بین الملل از جمله سخنرانان جوان، دیپلمات ها، متخصصان حقوقی، مقامات دولتی و مسئولین امور خارجه و مقامات سازمان های بین المللی است. دوره های آن به زبان انگلیسی ارائه می شود و بشکلی طراحی شده اند تا با دارا بودن جنبه علمی بسیار، کاربردی هم باشند. آکادمی شیامن تاکنون موفق به تشکیل و برگزاری سیزده برنامه تابستانی (از سال 2006) شده است که بیش از 90 نفر از اساتید مشهور حقوق بین الملل جهان شامل بسیاری از روسا و قضات دیوان بین المللی از آن جمله هستند. آکادمی پس از اولین دیدار هیئت مدیره آن در کاخ صلح لاهه در جولای 2005 تاسیس گردید. دوره تابستانی این آکادمی هر ساله در ماه جولای در مرکز اصلی دانشگاه شیامن، واقع در جزیره شیامن در جنوب شرقی چین برگزار می گردد. از جمله ویژگی های دوره کنونی هچون برخی دیگر از سالهای ماندگار، تدریس رئیس وقت دیوان بین المللی دادگستری است که در حال حاضر این مهم بر عهده قاضی عبدالقوی یوسف است. هر ساله به تعدادی از شرکت کنندگان کمک هزینه  سفر و اقامت پرداخت می شود. اطلاعات بیشتر را می توانید در پوستر و دفترچه راهنمای دوره دریافت کنید.

International Association of Centres for Federal Studies (IACFS)

Eligibility

Only young researchers, attached or associated with an IACFS member centre are eligible. They include full-time researchers, masters, doctoral and post-doctoral students. Former students of a centre may also apply as long as there is a demonstrable association with the member centre. The age limit is 35 years old at the time of tabling the application.

Young researchers are invited to submit a journal-length article (8 000 - 10 000 words) on a topic dealing with an aspect of federalism. The topic does not need to be linked to the theme of the IACFS annual conference. The paper must be an original work. It may have already been submitted for publication but not published. The paper must be written in English.

Process

A young researcher submits his or her work to the director of the centre and each centre may nominate up to three candidates.

Nominations and papers must be submitted to Professor Jaap de Visser ([e-mail]) no later than 30 April 2018.

Award

For 2018 the award comprises a return flight ticket to the IACFS annual conference in Canberra, Australia (25-27 October 2018), plus three days’ accommodation and a certificate. The award winner will be invited to present his/her paper at the IACFS conference. CFP

1) نخست وزیر پیشین نیوزلند(Sir Geoffrey Palmer)، پیشنویس قانون اساسی مدون شده ای را با ویژگی های درک آسان، انعکاس هویت و ملیت نیوزلند، حفاظت کننده از حقوق و آزادی ها و جلوگیری از سواستفاده از قدرت توسط دولتمردان را منتشر نمود.

2) قانونگذران ترکمنستان با تصویب بازنگری و اصلاح قانون اساسی، باتفاق آرا راه را برای ریاست مادام العمر رئیس جمهور کنونی(قربانعلی بری محمداف) هموار کردند. مجلس نمایندگان و شورای بزرگان با تصویب اصلاحاتی بدون هیچگونه رای مخالفی، طول دوره ریاست جمهوری را از پنج به هفت افزایش داده و محدودیت سنی هفتاد سال برای نامزدی را این مقام را حذف کردند؛ قربانعلی بری محمداف با تحصیلات دندانپزشکی از سال 2006 و پس از مرگ صفرمراد نیازف بر این مقام تکیه زده است. رئیس جمهور پیشین از سال 1990 تا زمان مرگش به اداره کشور پرداخت. 

3) نخست وزیر(Malcolm Turnbull ) مشترک المنافع استرالیا قصد دارد پس از تایید پارلمان، پرسش "آیا قانون باید برای ازدواج همجنسگرایان تغییر یابد؟" را به همه پرسی بگذارد.

4) کانادا قصد دارد از ایالات متحده آمریکا بخواهد سیاست مرزی خود را در خصوص ممنوعیت ورود اتباع کانادایی که ماری جوانا مصرف کرده اند را تغییر دهد.

تازه های بین المللی حقوق اساسی، سی ام اردیبهشت 1395

   

1-منتخب آرای دیوان قانون اساسی:

1) دیوان قانون اساسی جمهوری دموکراتیک کنگو اعلام کرد در صورت تاخیر در برگزاری انتخابات ریاست جمهوری در نوامبر آینده، رئیس جمهور کنونی(Joseph Kabila) می تواند همچنان به خدمت خود ادامه دهد.

2) دیوان قانون اساسی جمهوری سودان، پس از چهارماه تعلیق انتشار روزنامه التیّار بدستور سازمان اطلاعات و امنیت ملی، این دستور را لغو نمود.

2- تازه های بین المللی حقوق اساسی:

1) فرماندار ایالت آلاباما، دو قانون مربوط به محدودیت سقط جنین را امضا کرد.

2) 18 ماه می سالروز  تصویب اولین قانون اساسی ترکمنستان پس از استقلال از اتحاد جماهیر شوروی و روز ملی این کشور می باشد؛ در سال 2008 قانون اساسی جدیدی با تاکید بر حق تعیین سرنوشت جایگزین آن قانون شد. در مقدمه این قانون اساسی آمده است: "ما مردم ترکمنستان بر اساس حق ذاتی تعیین سرنوشت خویش خود را مسئول وضعیت کنونی و آینده وطن خود می‌دانیم. صادقانه به نیاکان خود اظهار می داریم در یکپارچگی، صلح و تفاهم زندگی میکنیم؛ حاکمیت مردم ترکمنستان را تقویت می‌نماییم، حقوق و آزادیهای شهروندان را تضمین کرده، صلح مدنی و وحدت ملی را تأمین می‌کنیم و اساس حکومت را برای مردم و دولت را بر پایه قانون قرار می‌دهیم، بدین وسیله این قانون اساسی را به عنوان قانون بنیادین ترکمنستان تصویب می‌کنیم."

3) با توجه به برگزاری همه پرسی در 23 ژوئن 2016 در انگلیس، جهت باقی ماندن یا نماندن در اتحادیه اروپا که اولین همه پرسی از یک کشور عضو اتحادیه برای باقی ماندن در آن می باشد، دسترسی به مقالات مرتبط در سالنامه مطالعات حقوق اروپایی کمبریج بصورت رایگان فراهم گردیده است.

1)  دیوان عالی ژاپن، با انتشار بیانیه ای، از صدور اجازه به دادگاه های تابعه برای انجام آزمایشات افراد مبتلا شده به جزام در محلی غیر از صحن دادگاه، عذرخواهی نمود.

 2)  دیوان عالی جمهوری هند با ابراز نگرانی از میزان زیاد وام های پرداخت شده و احتمال عدم بازپرداخت آنها، به دولت پیشنهاد نمود تا اقداماتی فوری برای بازپرداخت آنها را انجام دهد.

3) دیوان قانون اساسی جمهوری کلمبیا اعلام نمود ازدواج های همجنسگرایان می تواند از حمایت قانون اساسی برخوردار شود.

4)  دیوان عالی دادگستری جمهوری بولیواری ونزوئلا،  تلاش ها مخالفان برای کاهش دوره ریاست جمهوری نیکلاس مادرو را رد کرد.

 5)  دیوان عالی ایالات متحده آمریکا درخواست توقف اجرای قانون جنجالی شناسایی رای دهندگان را رد کرد.

2- تازه های بین المللی حقوق اساسی:

1) دیوان‌ عالی جمهوری فدراتیو برزیل، دستور تعلیق فعالیت‌های ادواردو کونا، رئیس مجلس این کشور که یکی از سرسخت‌ترین رقیبان دیلما روسف می باشد را صادر کرد.

2) در نشستی میان قضات ارشد و وزیر دادگستری جمهوری هند، توافق گردید تا برای کاهش مدت زمان دادرسی ها در دیوان عالی، قضات بازنشسته بتوانند در دوره ای کوتاه در دیوان عالی خدمت نمایند.

 3) بر اساس قوانین جدید، دولت جمهوری اتریش با اختیارات گسترده اعطا شده، می تواند از ورود پناهچویان به این کشور جلوگیری نماید.

4) با قانونگذاری های جدید در جمهوری خلق چین، اختیارات فوق العاده ای را برای نظارت بر عملکرد سازمان ها بین المللی غیر دولتی به نهادهای اجرایی این کشور اعطا گردید.

1- منتخب آرای  دادگاه های عالی:

1) دولت جمهوری ترکیه تصمیم دیوان قانون اساسی این کشور برای ابطال قوانینی که به دولت اجازه در نظر گرفتن مجازات دلخواه برای افسران پلیس می داد را غیرقابل پذیرش دانست.

2) رئیس دیوان قانون اساسی جمهوری چک، حمایت خود را از تلاش های دولت در محدود ساختن اختیارات ریاست جمهوری در تعیین رئیس بانک مرکزی، اعلام نمود.

3) دیوان قانون اساسی جمهوری دومنیکن، قسمت هایی از قانون مطبوعات را که به دولت اجازه مجازات اهالی مطبوعات و رسانه را میداد، ابطال نمود، با این وجود مجازات دیگر اشخاص غیررسانه ای همچنان برقرار خواهد بود.

4) دیوان قانون اساسی جمهوری فدرال آلمان، قسمتی از قانون وکلای فدرال را که مشارکت حرفه ای وکلا، پزشکان و داروسازان را منع کرده بود، خلاف قانون اساسی دانست. این دیوان همچنین، بررسی ممنوعیت فعالیت حزب راست افراطی "دمکراتیک ملی" را آغاز خواد کرد.  سنای آلمان معتقد است این حزب "نژاد پرست" و "ضد یهودی" است و دادخواستی به این منظور را به دیوان قانون اساسی ارائه داده است؛ به عقیده سنای آلمان "حزب دمکراتیک ملی" خطری برای امنیت آلمان محسوب می‌شود.

2- تازه های بین المللی حقوق اساسی:

1) نظرسنجی ها در ایرلند نشان می دهد اکثریت قابل توجه مردم آن کشور خواهان بازنگری در اصلاحیه هشتم قانون اساسی و مجاز شدن سقط جنین در برخی موارد حداقلی می باشد، در نتیجه دولت در نظر دارد تا مقدمات این همه پرسی را فراهم آورد.

2) ترکمنستان، قانون اساسی جدیدی را پیشنهاد نموده که در آن طول دوره ریاست جمهوری از پنج به هفت سال افزایش یافته و محدودیت سنی برای نامزدی این پست حذف گردیده است. 

3) شورای قانون اساسی فرانسه، مقرراتی که در وضعیت فوق العاده قانون اساسی به دولت اجازه جستجو و بازرسی بدون مجوز می دهد را تایید و همزمان نیروهای پلیس را از کپی برداری از مدارک بدست آمده از این تحقیقات منع نمود.

4)  جمهوری خلق چین، قانون جدیدی برای اکتشاف اعماق دریاها تصویب نمود و اعلام نمود که به تصمیمات قریب الوقوع، دیوان دایمی داوری لاهه در رابطه با اختلافات حاکمیتی دریا جنوب چین، اعتراض خواهد کرد.

5) تحقیقات در گرجستان نشان می دهد که این کشور می تواند ممنوعیت ازدواج همجنسگرایان را از طریق اصلاح قانون اساسی پیگیری نماید.

6)  نتایج رسمی همه پرسی برگزار شده در دولت چندملیتی بولیوی نشان می دهد، مردم این کشور با تغییر قانون اساسی و لغو محدودیت های طول دوره ریاست جمهوری که این امکان را به اِوو مورالس می داد تا برای بار چهارم در انتخابات ریاست جمهوری شرکت کند و تا سال 2025 رئیس جمهور باشد را رد کردند.

دوره تابستانی سال 94 آکادمی حقوق بین الملل شیامن

آکادمی حقوق بین الملل شیامن ثبت نام دوره تابستانی 2015 (24 تیرماه الی 9 مرداد سال جاری)خود را آغاز نمود.

دروس عمومی دوهفته از این دوره، توسط قاضی، هیساشی او وادا، رئیس پیشین دیوان بین المللی دادگستری درسالهای 2003 تدریس خواهد شد. دیگر دروس این دوره شامل مسئولیت دولت، صلاحیت و آیین دادرسی دیوان بین المللی دادگستری، حقوق اقتصادی بین الملل، داوری بین المللی، سازمان های بین المللی و .. می باشد. اطلاعات بیشتر در خصوص موضوعات این دوره را می توانید از اینجا بارگزاری نمایید.

دوره تابستانی آکادمی حقوق بین الملل لاهه

ثبت نام دوره های تابستانی 1393 آکادمی حقوق بین الملل لاهه از 10 آذر 1392(اول دسامبر) آغاز گردیده و تا 10 اسفند 1392 ادامه دارد.

دوره اول، حقوق بین الملل عمومی از 16 تیر 1393 تا 3 مرداد و دوره دوم، حقوق بین الملل خصوصی از تاریخ 6 مرداد تا 24 مرداد برگزار می گردد.

شایان ذکر است جناب آقای دکتر جمشید ممتاز، عضو سابق کمیسیون حقوق بین الملل و استاد حقوق بین الملل دانشگاه تهران نیز در دوره اول به تدریس "رتبه بندی نظام قانونی بین المللی[ Ranking of the International Legal Order]" می پردازند.
