Sponsored by Stanford Law School, the International Junior Faculty Forum (IJFF) was established to stimulate the exchange of ideas and research among younger legal scholars from around the world. We live today in a global community– in particular, a global legal community. The IJFF is designed to foster transnational legal scholarship that surmounts barriers of time, space, legal traditions and cultures, and to create an engaged global community of scholars. The Twelfth IJFF will be held at Stanford Law School in fall 2019 (the exact date has not yet been fixed; but it will most likely be in October 2019).

In order to be considered for the 2019 International Junior Faculty Forum, authors must meet the following criteria:

• Citizen of a country other than the United States
• Current academic institution is outside of the United States
• Not currently a student in the United States

ESRs will be employed by the University on a salary of £26,075 per annum, and will be eligible for a range of benefits including travel and research funding.

ESRs will propose and develop their own research projects around the theme of how political concepts have been fostered historically, debated philosophically and politically, fought over by social movements, codified in law, transmitted through education and the media, and lived out in everyday life. They will register for a PhD and work under the supervision of an interdisciplinary team of supervisors. They will receive extensive training, including in engagement with non-academic audiences, which will include one or more placements with one of our 23 partners. They will also participate in the activities of the Centre for Citizenship, Civil Society and the Rule of Law.

Successful applicants will be required to start on 1 September 2019 for a period of 3 years.

International Law and Democracy Revisited: The EJIL 30th Anniversary Symposium

EJIL was founded in 1989, coinciding with the fall of the Berlin Wall and the attendant excitement encapsulated by that well-known optimistic/hubristic End of History phraseology, with predictions of liberal democracy to become regnant in the world and a New International Legal Order to replace the old First World-Second World-Third World distinctions.

Thirty years later the state of democracy, whether liberal or social or any other variant, seems to be far from sanguine.

 

Here is but a partial list of the challenges to democracy in the contemporary world:

The advent of so-called ‘illiberal democracies’

The crisis and breakdown of trust within established democracies

The reality or otherwise of states with ‘formal democracy’ often reduced to little more than elections, more or less free

The accountability and rule of law concerns, famously termed GAL concerns, which transnational governance regimes raise as indispensable features of democracy

The persistent ‘democracy deficit’ or ‘political deficit’ of the European Union and similar Organizations

The emergence of the global ‘data economy’ with mega platforms calling into question basic assumptions about territory and jurisdiction and calling into question the ability of democratic regimes to reign in such platforms increasingly questioned

The impact of both financial markets and international monetary bodies on the internal margin of manoeuvre and democratic choices of economic management

Democracy and global inequality: The relationship between counter-democratic ideologies, legal reforms and political processes at the domestic and global levels and social and economic processes such as the shrinking middle class and the lasting ramifications of the 2008 economic crisis.

The list of challenges could go on quite a bit. The international legal order itself has come under stress and the interaction, descriptively and prescriptively, of international law with the question of ‘democracy’ has become complex, even messy.

 

We are issuing here a Call for Papers. International lawyers from practice and academia as well as scholars from related disciplines are invited to send an abstract of 350-500 words setting out the prospective papers they would like to submit for inclusion in the symposium dealing with any theme that comes within the overarching topic of International Law and Democracy. We will accept proposals for research papers of 10-12K words as well as shorter Think Pieces of 5-7K words.

 

The deadline for the Abstracts is 15 January 2019. Draft papers of those abstracts selected by a committee composed of members of the Editorial Boards of EJIL will be expected by 15 June. We are considering a workshop in Madrid in early July to discuss the drafts. Final version of papers will be expected by 15 September.

International Association of Centres for Federal Studies (IACFS)

Eligibility

Only young researchers, attached or associated with an IACFS member centre are eligible. They include full-time researchers, masters, doctoral and post-doctoral students. Former students of a centre may also apply as long as there is a demonstrable association with the member centre. The age limit is 35 years old at the time of tabling the application.

Young researchers are invited to submit a journal-length article (8 000 - 10 000 words) on a topic dealing with an aspect of federalism. The topic does not need to be linked to the theme of the IACFS annual conference. The paper must be an original work. It may have already been submitted for publication but not published. The paper must be written in English.

Process

A young researcher submits his or her work to the director of the centre and each centre may nominate up to three candidates.

Nominations and papers must be submitted to Professor Jaap de Visser ([e-mail]) no later than 30 April 2018.

Award

For 2018 the award comprises a return flight ticket to the IACFS annual conference in Canberra, Australia (25-27 October 2018), plus three days’ accommodation and a certificate. The award winner will be invited to present his/her paper at the IACFS conference. CFP

تازه های بین المللی حقوق اساسی بیست و ششم آذر 1395+Calls

1) روز جمعه(9 دسامبر/19 آذر) مجلس جمهوری کره، رای به  استیضاح رئیس جمهور پارک گئون های داد؛ وی بدلیل سو استفاده یکی از دوستانش از قدرت و اعتراضات مردم به این موضوع با رایی بیش از دوسوم آرای پارلمان  که نشان از حمایت حزب موافق خود بر برکناری دارد، از کار برکنار گردید؛ وی  بعنوان اولین رئیس جمهور برکنار شده توسط مجلس تا زمان رسیدگی دیوان قانون اساسی، از پست خود معلق گردیده و اختیارات و مسئولیت های ریاست جمهوری نیز مطابق قانون اساسی به نخست وزیر محول می گردد، دیوان قانون اساسی 180 روز مهلت دارد تا این استیضاح را تایید یا رد نماید.


2) سرجو ماتارلا، رئیس جمهوری ایتالیا، رسما پائولو جنتیلونی را به سمت نخست‌وزیر ایتالیا منصوب کرد. جنتیلونیِ ۶۲ ساله  گفته است که با "افتخار و حس مسئولیت" این وظیفه را انجام خواهد داد. پائولو جنتیلونی از معتمدان نزدیک ماتئو رنتسی، نخست‌وزیر مستعفی ایتالیا و هم‌حزبی او درحزب دمکرات ایتالیا (PD) است. او در عین عضویت در این حزب چپ میانه، به اعتدال و عملگرایی معروف است.  دوشنبه (۵ دسامبر) ماتئو رنتسی پس از شکست در همه پرسی اصلاح قانون اساسی استعفا ی خود را تحویل رئیس جمهوری این کشور داد. استعفای رنتسی پذیرفته شد، اما تا زمان تشکیل دولت گذار، رنتسی باید در مقام خود انجام وظیفه می‌کرد. مردم ایتالیا در همه‌پرسی روز یکشنبه (۴ دسامبر/ ۱۴ آذر) به بازنگری قانون اساسی این کشور "نه" گفتند. هزینه سیاسی این همه پرسی برای ماتئو رنتسی، نخست وزیر ایتالیا، کناره‌گیری از مقام خود بود.


3) 12دسامبر روز قانون اساسی فدراسیون روسیه است. پس از برگزاری همه پرسی در این روز قانون اساسی کنونی جایگزین قانون اساسی جمهوری فدراتیو شوروی سوسیالیستی شد. این قانون ٢٥ دسامبر همان سال اجرایی گردید.

4) یحیی جامع، رئیس جمهوری اسلامی گامبیا بعد از ۲۲ سال در انتخابات سراسری این کشور شکست خورد. برنده این انتخابات آداما بارو، یک تاجر ساده و مالک یک شرکت ساخت و ساز است. او پیش از آنکه به گامبیا برگردد در فروشگاه لوازم خانگی آرگوس در لندن کار می‌کرد. آقای بارو به نمایندگی از سوی ائتلافی از هفت حزب مخالف در انتخابات شرکت کرد و تنها به دلیل بازداشت تقریبا تمام رهبران مخالف دولت به رقیب اصلی رئیس جمهور تبدیل شد. رئیس ستاد برگزاری انتخابات گامبیا گفته بود که آقای جامع نتیجه انتخابات را پذیرفته است. اما هم اکنون رهبر گامبیا یک هفته پس از پذیرش شکست در انتخابات ریاست جمهور اکنون نتایج انتخابات را رد کرده است. آقای جامع در تلویزیون دولتی گامبیا با ذکر "حوادث غیرعادی" در رای گیری خواستار برگزاری دوباره انتخابات شد. آقای جامع که در پی یک کودتا در سال ۱۹۹۴ به قدرت رسیده بود متحمل شکست غافل گیرکننده ای از آدام بارو شد.

آقای جامع گفت که او اکنون "به طور کامل" نتیجه انتخابات را رد می کند. او گفت که "پس از تحقیقات کامل تصمیم گرفته ام که نتیجه انتخابات اخیر را رد کنم." او خواستار برگزاری "انتخابات مجدد و شفاف" شد. آقای جامع هفته پیش در تلویزیون دولتی ضمن قبول شکست برای آقای بارو آرزوی موفقیت کرد. او گفت: "شما رئیس جمهور منتخب گامبیا هستید و برایتان بهترین ها را آرزو می کنم. من هیچ سوءنیتی ندارم."

به گفته کمیسیون انتخابات آقای بارو با ۲۳۶ هزار و ۵۱۵ رای یعنی ۴۵.۵ درصد آرا در مقابل ۳۶.۷ درصد رای برای آقای جامع برنده شد. آقای جامع در طول ۲۲ سال حکومت به عنوان رهبری بی رحم شهرت یافت. دیدبان حقوق بشر پیش از انتخابات او را به استفاده از خشونت برای خاموش کردن منتقدان متهم کرده بود.

جمهوری اسلامی گامبیا کوچکترین کشور آفریقا و پایتخت آن بانجول است. جمعیت این کشور یک میلیون و ۷۷۶ هزار نفر و زبان رسمی این کشور انگلیسی است.

5) 10 دسامبر، سالروز تشکیل پادشاهی تایلند پس از قیام مردمی سال 1932 و پایان یافتن سلطنت مطلقه در این کشور است. قیام و قدرت گرفتن حزب مردمی در ژوئن همان سال موجب تصویب قانون اساسی کنونی گردید.

1) نتایج همه پرسی در جمهوری ایتالیا از شکست سنگین پیشنهاد ماتئو رنتسی، نخست وزیر، برای کاهش اختیارات سنا و افزایش قدرت دولت مرکزی در این کشور حکایت دارد. مردم ایتالیا برای شرکت در همه‌پرسی اصلاح قانون اساسی این کشور روز (یکشنبه چهارم دسامبر-۱۴آذر) به پای صندوق‌های رای رفتند. بنابر گزارش رسانه‌های ایتالیا نظرسنجی‌های بعد از همه پرسی نشان می دهد مخالفان اصلاحات پیشنهادی نخست وزیر با ۵۴-۵۸ درصد بر حامیان آن که ۴۲-۴۶ درصدند پیروز شده‌اند.  در نخستین ساعت پس از شمارش اولیه آرا، ۶۰ درصد مردم ایتالیا مخالفت خود را با اصلاح قانون اساسی این کشور اعلام کرده بودند. موضوع همه‌پرسی کاهش اعضای سنا و تغییر در شیوه انتخاب آنان بود. با اعمال این اصلاحات هماهنگی بیشتری بین دو مجلس ایتالیا ایجاد می‌شد و امر حکومت کردن در این کشور را تسهیل می‌کرد. بر اساس آمار اعلام شده ۷۰ درصد افراد واجد شرایط در این نظرسنجی شرکت کرده‌اند. وزارت کشور ایتالیا ضمن اعلام این میزان از مشارکت مردم از پیروزی ائتلاف احزاب مخالف اصلاحات خبر داده است. بر این اساس، رهبر پوپولیست حزب جنبش پنج ستاره، بپه گریلو، همراه با لیگا نورد که یک حزب راست با تمایلات خارجی ستیزانه است و همچنین حزب فورسا ایتالیا به رهبری برلوسکونی نتیجه این نظرسنجی را به سود خود رقم زده‌اند. ماتئو رنتسی ضمن پذیرش شکست خود در این همه پرسی، اعلام کرد روز دوشنبه رسما از مقام خود کناره گیری کرده و استعفا ی خود را تحویل رئیس جمهوری ایتالیا، سرجیو ماتارلا خواهد داد. ماتئو رنتسی فوریه ۲۰۱۴ با ۴۱ سال سن به عنوان جوان‌ترین نخست وزیر ایتالیا شروع به کار کرد. رویکرد او نسبت به اتحادیه اروپا، رویکردی مثبت بود و با صدراعظم آلمان، آنگلا مرکل مناسباتی دوستانه داشت.

2)حشد شعبی در جمهوری عراق با مصوبه مجلس عراق تبدیل به یک نهاد قانونی و بخشی از ارتش این کشور و دارای حقوق برابر با آن شد. بر اساس این قانون، گروه‌ها و تشکیلات حشد شعبی به‌عنوان نیروی پشتیبان نیروهای امنیتی عراق به وظایف خود پایبند هستند و تا زمانی که تهدیدی برای امنیت ملی عراق تشکیل ندهند، حق حفظ هویت و ویژگی‌های خود را دارند. همچنین  افراد و وابستگان تشکیلات و گروه‌های تشکیل دهنده حشد شعبی و شهدا، مجروحان و مفقودان آنها از همان حقوق و مزایای بازنشستگی و امتیازهایی که افراد مشابه آنها در وزارت دفاع و کشور عراق بهره‌مند هستند، برخوردار می‌شوند. سید عمار حکیم رئیس مجلس اعلای اسلامی عراق و رئیس ائتلاف ملی عراق ضمن استقبال از این مصوبه، آن را گامی ملی برای ثبات عراق خواند. 

3) مجلس جمهوری کره(جنوبی) قصد دارد جمعه آینده (19 آذر/۹ دسامبر) درباره استیضاح رئیس جمهور کشور رأی‌گیری کند. خانم پارک گئون های روز سه شنبه (۲۹ نوامبر) اعلام کرد در صورتی که پارلمان مایل باشد، او برای کناره‌گیری از مقام خود آماده است. نیروهای سیاسی مخالف کناره‌گیری خانم پارک را تقاضا کرده‌اند و روز جمعه پارلمان قرار است در این باره رأی‌گیری کند.  پارلمان کره جنوبی ۳۰۰ نماینده دارد و گفته می‌شود ۱۷۱ نماینده با کناره‌گیری رئیس جمهور موافق هستند. اما برای عملی شدن این تصمیم موافقت ۳۱ نفر از نمایندگان حزب حاکم نیز ضرورت دارد. چنانچه پارلمان به کناره‌گیری رئیس جمهور رأی دهد، این رأی به دیوان  قانون اساسی ارسال می‌شود و بررسی این دیوان نیز نیز تا ۶ ماه طول خواهد کشید. حزب خانم رئیس جمهور به او فرصت داده که تا پایان ماه آوریل استعفا دهد. چنانچه رئیس جمهور به این حکم تن ندهد، حزب او به نظر مخالفان می‌پیوندد. 

4) شورای قانون اساسی جمهوری فرانسه، مقررات مربوط به طلاق توافقی(قراردادی) غیرقضایی را در تطابق قانون اساسی اعلام نمود. 

5) در جمهوری هند بحث در مورد اصلاح قانونی بالا گرفته که حقوق زنان مسلمان را آشکارا نقض می‌کند. این قانون که در دوره استعمار ریشه دارد، به مردان مسلمان اجازه می‌دهد با گفتن تنها سه کلمه زنان خود را بدون پیامد قانونی طلاق دهند. قانون طلاق در هند به مردان مسلمان اختیار می‌دهد با سه بار تکرار واژه "طلاق" از زنان خود جدا شوند. مردان حتی لازم نیست این سه کلمه را شخصا به همسرشان بگویند؛ نوشتن اس‌ام‌اسی حاوی این سه کلمه یا تکرار کلمه پشت تلفن هم کفایت می‌کند. چنین طلاقی قانونی است و زنان هم حق اعتراض ندارند. موضعگیری اخیر نخست وزیر هند درباره لزوم مقابله با "طلاق سه کلمه‌ای" به بحث‌های ماه‌های اخیر درباره لزوم حمایت از حقوق زنان مسلمان دامن زده است. نارندرا مودی ناسیونالیست که خود بودایی سفت و سختی است، از حق زنان مسلمان حمایت کرده است. مودی می‌پرسد: «آیا باید اجازه دهیم که حق خواهران مسلمانمان پایمال شود، فقط به صرف این‌که کسی سه بار پشت تلفن می‌گوید طلاق؟» مودی با این سخن در واقع بر لزوم رعایت حقوق اقلیت‌ها و زنان و نقش دولت سکولار در بزنگاه‌های اجتماعی تأکید کرده است. روحانیان مسلمان در هند اصلاح قانون یادشده را تهدید جامعه‌ی مذهبی مسلمانان این کشور برمی‌شمرند. اکثریت آنها طرفدار راه‌حلی اختیاری هستند؛ قانون طلاق در هند  متعلق به دوره‌ی استعمار است؛ دوره‌ای که در آن بریتانیا به اقلیت‌ های مذهبی در هند اجازه داده بود مسائل داخلی خود، از جمله ازدواج و طلاق، را خود حل و فصل کنند. هنوز هم حقوق خانواده برای ۱۸۰ میلیون مسلمان در هند برگرفته از قوانین شرعی است. 

6) کانادا با رفع ممنوعیت های پیشین، قصد بازگرداندن حق رای دهی به شهروندان کانادایی که بیش از پنج سال در خارج از کشور زندگی کرده اند را دارد.

7) حزب حاکم عدالت و توسعه جمهوری ترکیه در نظر دارد قانون اساسی این کشور را تغییر دهد و نظام ریاستی را جانشین سیستم کنونی حکومتی در این کشور کند. حزب ملی‌گرای افراطی این کشور نیز موافق این طرح است. بینالی ییلدیریم، نخست وزیر ترکیه، به هنگام طرح برنامه خود برای تغییر نظام حکومتی ترکیه در آنکارا گفت: «اگر خدا بخواهد پیشنهادمان را برای بازنگری در قانون اساسی هفته آینده به پارلمان ارائه خواهیم داد.»

در صورتی که ۶۰ درصد نمایندگان پارلمان ترکیه با این پیشنهاد موافقت کنند، این طرح در آغاز فصل تابستان به رای‌گیری عمومی گذاشته می‌شود. پیش‌شرط‌های لازم برای به دست آوردن اکثریت ۶۰ درصد آرا در پارلمان ترکیه آماده شده است. نخست وزیر ترکیه گفته است که مهم‌ترین موضوع در اصلاح قانون اساسی این است که رئیس جمهوری در سیستم آینده حکومتی موظف نیست از نظر سیاسی بی‌طرف باشد و به حزبی تعلق نداشته باشد. این موضوع نیز با تایید رهبری حزب حرکت ملی ترکیه همراه است. دو حزب عدالت و توسعه و حرکت ملی  بیش از ۳۳۰ کرسی نمایندگان پارلمان ترکیه را در اختیار دارند و می‌توانند با تایید طرح در پارلمان آن را در آغاز تابستان به رای‌گیری عمومی بگذارند. در صورتی که این طرح در پارلمان ترکیه دو- سوم آرا را به دست آورد، دیگر نیازی به برگزاری همه پرسی عمومی نیست و لازم الاجرا خواهد بود.

8) توافقنامه صلح بین دولت جمهوری کلمبیا و نیروهای مسلح انقلابی (فارک)تصویب نهایی رسید. پس از مجلس سنای کلمبیا، مجلس نمایندگان این کشور نیز طرح یاد شده را تصویب کرد. اجرایی شدن این طرح به منازعه‌ای خونین در کلمبیا پایان می‌دهد. توافقنامه‌ی صلح در مجلس نمایندگان کلمبیا به اتفاق‌آراء تصویب شد و ۱۳۰ نماینده به آن رای مثبت دادند. نمایندگان مخالف با این توافقنامه، تعمدا در رای‌گیری شرکت نکرده بودند. تصویب نهایی توافقنامه‌ی صلح برای خوان مانوئل سانتوس، رئیس‌جمهوری کلمبیا که پیش از این برای تلاش‌هایش در این راه جایزه‌ی نوبل صلح در سال ۲۰۱۶ را به دست آورده بود، موفقیت بزرگی به شمار می‌رود. او از کنگره‌ی کلمبیا برای تصویب این طرح قدردانی کرد و این اقدام را "حمایتی تاریخی و امیدی برای صلح در کلمبیا" خواند. 

9) پارلمان پادشاهی هلند به ممنوعیت پوشش صورت با برقع یا نقاب در مکان‌های عمومی رای مثبت داد. بدین ترتیب پس از  جمهوری بلغارستان، جمهوری فرانسه، پادشاهی بلژیک، کنفدراسیون سوئیس و جمهوری ایتالیا که پوشش کامل صورت را برای زنان مسلمان منع کرده‌اند. هلند هم به جمع برخی از کشورهای اروپایی پیوست که اخیرا قوانین پوشش برای زنان محجبه را محدود کرده‌اند. این قانون باید در سنا هم تایید شود. طبق این ممنوعیت، احراز هویت در مکان‌هایی که ضرورت دارد مثل ساختمان‌های دولتی، مدارس و بیمارستان‌ ها باید انجام شود. سرپیچی از این قانون می‌تواند با جریمه‌ای نقدی تا ۴۰۰ یورو همراه باشد. زنان اندکی در هلند از چنین پوشش‌هایی استفاده می‌کنند، اما این مساله سال‌هاست که در صدر دستورکار قرار دارد و این به درخواست اصلی حزب اپوزیسیون ضد اسلامی "حزب آزادی" تبدیل شده بود. این حزب در آستانه انتخابات ماه مارس در نظرسنجی‌ها پیشتاز است. مخالفان می‌گویند این قانون آزادی دینی زنان مسلمان را محدود می‌کند. به گفته‌ی خدیجه عریب، رئیس پارلمان هلند، اکثریت نمایندگان به قانون ممنوعیت پوشش کامل زنان در مکان‌های عمومی رای مثبت دادند. حال این قانون باید از نظر سنای این کشور نیز بگذرد. شمار زنانی که در هلند همیشه از پوشش کامل استفاده می‌کنند، تنها بین ۱۰۰ تا ۱۵۰ نفر تخمین زده می‌شود. 

10)  نمایندگان مجلس پادشاهی تایلند ولیعهد "واجیرالونگکورن" که تنها پسر او و دومین فرزند ارشد پادشاه پیشین، بهومیبول آدولیادج،که در 13 اکتبر سال جاری و در سن 88 سالگی درگذشت را به عنوان پادشاه جدید این کشور معرفی کرد.پادشاه پیشین در سال 1972 وی را  عنوان جانشین و ولیعهد تعیین کرده بود. کابینه دولت تایلند بر طبق قانون انتصاب جانشین پادشاه مربوط به سال 1924، نام واجیرالونگکورن را به عنوان پادشاه جدید در پارلمان مطرح کرده و پارلمان تایلند نیز رسما او را به عنوان پادشاه جدید تایید کرد. پورنپچ ویچیتچولچای، رئیس پارلمان تایلند موسوم به مجمع‌ملی گفت: از همه می خواهم دعای خیر خود را نثار پادشاه جدید کنند و به به دنبال آن نمایندگان نیز فریاد "زنده باد پادشاه" سر دادند. با این وجود، تاریخ برگزاری مراسم تاجگذاری این پادشاه تازه کار هنوز مشخص نگردیده است. 

11) جمهوری اسلونی، با بازنگری در قانون اساسی خود، حق دسترسی به آب قابل شرب را به حقوق بنیادین شهروندان خود برای جلوگیری از جنبه تجاری آن، اضافه نمود.

12) دیوان عالی جمهوری فدرال آلمان حکم حبس علیه "حسابدار آشویتس" را  به جرم همکاری در کشتار دست‌کم ۳۰۰ هزار نفر در دوران رژیم نازی تأیید کرد. اسکارگرونینگ در سال ۲۰۱۵ به چهار سال حبس محکوم شده بود. در ماه ژوئیه سال ۲۰۱۵ میلادی بود که اسکار گرونیگ، مشهور به "حسابدار آشویتس"، در دادگاهی در لونه‌بورگ به جرم همکاری در قتل دست‌کم  ۳۰۰ هزار نفر به چهار سال حبس محکوم شد. او به مدت دوسال از سپتامبر ۱۹۴۲ تا اکتبر ۱۹۴۴ در "گردان حفاظتی" (Schutzstaffel) ارتش نازی که به طور مخفف "اس اس" خوانده می‌شد، خدمت می‌کرد. او در جریان محاکمه اعتراف کرده بود که در اردوگاه مرگ آشویتس به دارایی‌های یهودیانی که در آنجا محبوس بوده‌اند، رسیدگی می‌کرد و بر انتقال آنان به این اردوگاه نظارت داشته است.

گرونیگ که اکنون ۹۵ سال دارد، خود را بیگناه خوانده در مصاحبه‌هایش تأکید کرده بود که هیچ کس را نکشته و تنها "چرخ کوچکی در ماشین مرگ" بوده است. او پس از اعلام حکم دادگاه لونه‌بورگ خواستار تجدیدنظر در حکمش شده بود؛ حکمی که اکنون با تأیید دیوان عالی فدرال آلمان باید به اجرا گذاشته شود. از دید قاضیان آلمان گرونیگ اگر چه به طور مستقیم در جنایات نازی‌ها در اردوگاه مرگ آشویتس شرکت نداشته، اما با اعمال خود در گردش "چرخ کشتار" رژیم ناسیونال سوسیالیسم سهیم بوده و همکاری داشته است. اینکه گرونیگ برای گذراندن دوران حبس واقعا روانه زندان خواهد شد، بستگی به سلامتی و وضعیت جسمی او دارد. نکته مهم آن است که تصمیم تاریخی دیوان عالی آلمان راه را اکنون برای دادگاهی کردن کسانی که در دوران رژیم نازی چنین فعالیت‌هایی داشته‌اند، باز می‌کند. در طی دهه‌های گذشته شمار زیادی از کسانی که در فاجعه هولوکاست با نازی‌ها همکاری داشتند، از خطر محاکمه و دادگاهی شدن جسته بودند، چرا که خود به‌طور مستقیم و با دست خود در قتل انسان‌ها سهیم نبودند.

13) شورای دولتی جمهوری کوبا با انتشار بیانیه‌ای اعلام کرد: "مردم کوبا در روز سه شنبه ۲۹ نوامبر(۹ آذر) با تجمع در میدان انقلاب شهر هاوانا، پایتخت برای آخرین بار با فیدل کاسترو، رهبر سابق این کشور وداع می کنند." قرار است خاکستر فیدل کاسترو به "کاروان آزادی" مسیری که او و همرزمانش در جریان انقلاب کوبا طی کردند، برده شود. هواداران آقای کاسترو می‌گویند او کوبا را به مردم آن کشور برگرداند اما مخالفانش او را به سرکوب منتقدان متهم می‌کردند. آقای کاسترو که از زمان انقلاب سال ۱۹۵۹ تا زمان انتقال قدرت به برادرش، کوبا را با سیستم تک حزبی اداره می کرد در سال 2006 طی روندی قدرت را به رائول کاسترو، برادر جوان‌تر خود منتقل کرد. فیدل کاسترو فرماندهی انقلاب منجر به سرنگونی رژیم باتیستا در کوبا را در سال ۱۹۵۹ برعهده داشت و از همان زمان، سمت ریاست هیئت وزیران - یا نخست وزیری- را در دست گرفت. وی از سال ۱۹۶۵، سمت دبیر اول حزب کمونیست کوبا و از سال ۱۹۷۶ مقام ریاست شورای دولتی - رییس جمهور ی - کشور را نیز در اختیار داشت و در سال ۲۰۱۱ از آخرین سمت رسمی خود یعنی دبیرکلی حزب کمونیست استعفا کرد. او پس از کناره‌گیری از قدرت به ندرت در انظار عمومی و عرصه سیاسی حاضر شد. او تنها هر از چند گاهی برای روزنامه دولتی کوبا، یادداشت می‌نوشت. 

14) (۲۶ نوامبر)، نزدیک به ۴۸۰ هزار کویتی حائز شرایط به پای صندوق‌های رای می‌روند تا پارلمان این کشور را که "شورای مشورتی امیر" خوانده می‌شود، انتخاب کنند. این هفتمین بار در ده سال گذشته است که "شورا" به خواست شیخ صباح، امیر دولت کویت منحل و انتخابات جدید برگزار می‌شود. "شورای مشورتی امیر" از ۵۰ عضو تشکیل می‌شود. برای این دوره از انتخابات، ۲۸۷ تن از جمله ۱۴ زن خود را نامزد کرده‌اند. زنان در کویت از سال ۲۰۰۵ از حق انتخاب کردن و انتخاب شدن برخوردارند. با این حال در ۷ دوره‌ی گذشته تنها ۳ زن به پارلمان راه یافته‌اند. در آخرین شورای منحل شده، تنها یک زن به عنوان نماینده‌ی زنان که اکثریت حائزان شرایط انتخاب را تشکیل می‌دهند، در مجلس حضور داشت. کارشناسان معتقدند که جامعه‌ی محافظه‌کار کویت و اتخاذ سیاست‌های قبیله‌ای ـ اسلامی این امیرنشین مانع از فعالیت بیشتر زنان در پارلمان بوده ‌است.

بر اساس نتایج رسمی اعلام شده در دولت کویت، نیروهای مخالف توانستند در جریان انتخابات پارلمان کویت ۲۴ کرسی از مجموع ۵۰ کرسی "مجلس امت" (مجلس‌الامه) را از آن خود کنند. نمایندگان برگزیده‌شده به طیف رنگارنگی از نیروهای اسلام‌گرا، لیبرال و ملی‌گرایی تعلق دارند که هر دو انتخابات پیشین را به‌خاطر، به گفته‌ی خود، تغییر ناعادلانه‌ی سیستم انتخاباتی تحریم کرده بودند. ابتدا شمار دقیق مخالفان در مجلس نامشخص بود، زیرا در کویت حزبی وجود ندارد و تعلق گروهی سیاستمداران همواره روشن نیست. تعدادی از نزدیکان به گروه "اخوان‌المسلمین" در میان راه یافتگان به مجلس دیده می‌شوند. وابستگان به اقلیت شیعه که حدود ۳۰ درصد جمعیت این کشور را تشکیل می‌دهد، توانستند ۶ کرسی مجلس را به خود اختصاص دهند. آنها پیش از این ۹ کرسی را در اختیار داشتند. گفته می‌شود که حدود یک سوم از راه یافتگان به مجلس کویت چهره‌هایی جدید و جوان هستند. میزان مشارکت عمومی ۷۰ درصد اعلام شده است. برخلاف آنچه نتایج رسمی نشان می‌دهد، در آستانه انتخابات کسی شانس چندانی برای اپوزیسیون نمی‌دید. نمایندگان مخالف توانستند نزدیک به نیمی از کرسی‌های مجلس را به خود اختصاص دهند. حال آنها می‌توانند وزیران برگزیده امیر را استیضاح کنند. مجلس کویت در چارچوب نظام سلطنت مشروطه، به مراتب از حقوقی بیش از اکثر دیگر کشورهای عربی برخوردار است. مجلس قانون وضع می‌کند و می‌تواند در صورت داشتن دو سوم آرا، حتی برخلاف نظر امیر قانونی را به تصویب برساند، می‌تواند اعضای کابینه‌ی برگزیده شده از سوی امیر کویت را برکنار کند. از این گذشته می‌تواند اعضای خاندان‌سلطنتی را هم به چالش بکشد و همچنین در تعیین جانشین امیر سهیم باشد. ولی این حقوق تا کنون از سوی شیخ‌صباح‌احمد‌جابر‌صباح، امیرکویت که از سال ۲۰۰۶ بر تخت پادشاهی تکیه زده، به رسمیت شناخته نشده‌اند. امیر ۸۷ ساله‌ی کویت همواره کوشیده است در مراحل بحرانی به سود خاندان و منافع خود عمل کند. انحلال پی در پی "مجلس امت" در ده سال گذشته نیز به دلایل گوناگونی صورت گرفته است؛‌گاهی به بهانه‌ی "به‌خطر افتادن منافع کشور"، گاهی به دلیل "مغایرت با قانون اساسی" و زمانی هم به خاطر "حفظ امنیت‌ملی." طبق نتایج شمارش آرا، ۴۹ کرسی از ۵۰ کرسی مجلس را مردها اشغال کرده‌اند. تنها زن راه یافته به مجلس کویت صفاءالهاشم، سیاستمدار ۵۲ ساله‌ی لیبرال است. خانم هاشم یکی از ۱۵ زنی بود که برای راه یافتن به پارلمان کویت نامزد شده بودند. این سیاستمدار مجرب در دوره‌های پیشین هم نماینده مجلس بوده است.

1) نیکلا استرجن، رئیس دولت اسکاتلند، اعلام کرد حوادث سیاسی پس از اعلام نتایج همه پرسی در بریتانیا و مشخص شدن خروج این کشور از اتحادیه اروپا، او را باز هم بیش از پیش متقاعد کرده که در سه سال آینده باید یک همه‌پرسی در اسکاتلند در ارتباط با استقلال از بریتانیا برگزار شود. در سپتامبر سال ۲۰۱۴ یک همه‌پرسی در اسکاتلند در ارتباط با استقلال از بریتانیا انجام شد. در آن زمان ۵۵ درصد از واجدان شرایط به ماندن اسکاتلند در بریتانیا رای دادند. همه‌پرسی در بریتانیا در بیست‌و‌سوم ماه ژوئن سال جاری میلادی (۲۰۱۶) مشخص کرد که این کشور خواستار خروج از اتحادیه اروپاست. همین امر سبب شد که مردم اسکاتلند که با  ۶۲ درصد آرا به ماندن در اتحادیه اروپا رای داده بودند نارضایتی خود را اعلام کنند.

2) در نبود قانون اساسی مدون و پس برگزاری همه پرسی خروج از اتحادیه اروپا، برخی از اعضای پارلمان بریتانیا بر این عقیده هستند که نتیجه همه پرسی تنها نظری مشورتی می باشد و نخست وزیر نمی تواند بصورت یکجانبه به آن ترتیب اثر دهد، در همین راستا مباحث حقوقی مربوطه در دادگاه های سلطنتی آغاز گردیده تا مشحص گردد آیا تصویب پارلمان نیز برای اجرایی شده این همه پرسی مورد نیاز است؟!

3) پس از آنکه مردم کلمبیا با شرکت در همه پرسی، به قرارداد صلح با نیروهای مسلح انقلابی کلمبیا(FARK) فارک "نه" گفتند و مخالفت خود را با این اقدام دولت بیان نمودند. توافق آتش بس میان دولت جمهوری کلمبیا واین نیروها تا پایان سال میلادی تمدید گردید در حالی که مذاکرات  برای دستیابی به توافقی جدید ادامه دارد، در همین حال گروه های مخالف سیاسی نیز خواستار بررسی اتهام جنایت جنگی علیه اعضای این گروه شدند.

4)دیوان عالی جمهوری عراق با تصمیم حیدرالعبادی نخست وزیر این کشور در حذف سه معاونت ریاست جمهوری مخالفت کرد. 

5) دیوان عالی جمهوری اندونزی، اجازه زیست محیطی برای احداث کارخانه سیمان جدید که توسط بزرگترین شرکت دولتی سیمان این کشور را باطل نمود.

6)دیوان عالی جمهوری هند، در حکمی اعلام نمود کارگران جنسی، نمی توانند علیه مشتریان خود، شکایت عدم پرداخت مطرح نمایند.

7)یکی از دادگاه های عالی جمهوری فیلیپین، به رئیس جمهور(Rodrigo Duterte) هشدار داد در صورت واگذاری حق حاکمیت این کشور در قضیه (Scarborough Shoal) به جمهوری خلق چین، با استیضاح مواجه خواهد شد.

8)دیوان قانون اساسی جمهوری کرواسی، رسیدگی به درخواست تجدیدنظر 25 ساله نسبت به ممنوعیت سقط جنین در این کشور را آغاز نمود.

9) دیوان قانون اساسی جمهوری ترکیه، درخواست بزرگترین حزب سیاسی مخالف دولت برای ابطال دستورات اضطراری صادره پس از کودتا را بدلیل عدم صلاحیت رد نمود.

10) دیوان عالی جمهوری بولیواری ونزوئلا، علی رغم وجود الزام قانونی درقانون اساسی به نیکلاس مادرو اجازه داد تا بودجه سال 2017 این کشور را با فرمان ریاست جمهوری و بدون ارسال به مجلس ملی این کشور اجرایی نماید.

11)مجلس سنا جمهوری ازبکستان بمناسبت هشتم دسامبر، روز تصویب قانون اساسی این کشور عفو دسته جمعی زندانیان این کشور را تصویب نمود.

12)پارلمان جمهوری فرانسه، قانون جدیدی را بتصویب رسانید که به اشخاص تراجنسیتی(دگرجنسگونه) اجازه می دهد بدون استرلیزاسیون به ثبت وضعیت حقوقی خود بپردازند.

13)در حالی که دولت جمهوری بوروندی به سه نفر از بازرسان ملل متحد اجازه ورود به قلمرو خود را نداده است، پارلمان این کشور با اکثریت آرا، رای به خروج این کشور از دیوان کیفری بین المللی داد.

1) در همه پرسی هفته گذشته برای بازنگری و اصلاح قانون اساسی جمهوری آذربایجان، 88.6 درصد از رای دهندگان رای مثبت به این تغییرات دادند که شامل حذف حداقل شرط سنی برای کسب مقام ریاست جمهوری، افزایش طول دوره ریاست جمهوری از پنج به هفت سال و ایجاد مقام "معاون اول ریاست جمهوری" و "معاون رئیس جمهور،"می گردد. پیش از برگزاری این همه پرسی، سازمان عفو بین الملل نسبت به سرکوب مخالفان و منقتدین و نقض حق آزادی بیان ابراز نگرانی کرده بود.

2) امروز شهروندان مجارستان در همه پرسی شرکت میکنند تا در باره‌ی تصمیم اتحادیه‌ی اروپا مبنی بر "تقسیم  پناهجویان" و سهمیه‌ی این کشور رای بدهند. بر اساس این تصمیم، قرار است مجارستان سهمیه‌ای بالغ بر ۱۲۹۴ پناهجو را بپذیرد. اتحادیه‌ی اروپا از سال ۲۰۱۵ کوشیده‌ است، در نشست‌های متعدد خود زمینه‌ی سهمیه‌بندی ۱۶۰ هزار پناهجو را فراهم آورد.

انتظار می‌رود شهروندان مجارستان، با حمایت از موضع دولت ویکتور اوربان، نخست وزیر این کشور، به تصمیم اتحادیه‌ی اروپا پاسخ "نه" بدهند. دولت اوربان، پذیرش پناهجویان را "خطری جدی برای امنیت سیاسی و اجتماعی، هم‌چنین دین مسیحیت" در این کشور ارزیابی می‌کند.

کارشناسان سیاسی معتقدند،"خطرات" یادشده تنها ساخته و پرداخته‌ی دستگاه تبلیغاتی دولت محافظه‌کار اوربان است و بوداپست سال‌ها است که می‌کوشد خارجی‌های متمول را به اقامت در کشور خود تشویق و ترغیب کند؛ بر اساس گزارش رسانه‌ها، دولت مجارستان از سه سال پیش کوشیده‌ است در چارچوب "برنامه‌ی کسب حق اقامت"، مهاجران ثروتمند را به کشور خود دعوت ‌کند. تنها شرط کسب اجازه‌ی سکونت در مجارستان خرید اوراق قرضه‌ی دولت به مبلغ ۳۰۰ هزار یورو است. متقاضیان حائز شرایط و خانواده‌های آنان، ابتدا حق سکونت ۲ ماه در مجارستان را کسب می‌کنند. در پایگاه اینترنتی این "برنامه" آمده است که سفر به کشورهای عضو شنگن، از جمله مزایای کسب این گونه اقامت است.

3) پس از عدم پیروزی در انتخابات، رهبر مخالفان در جمهوری گابن خواستار تحریم اعضای دولت به دلیل تقلب در انتخابات شد و  ایده همکاری با دولت علی بونگو را که مجددا به ریاست جمهوری انتخاب شده است را فاقد ارزش دانست.

4) حزب جمهوری خواه خلق ترکیه(CHP) فرمان های اضطراری صادره پس از کودتا را خلاف قانون اساسی دانست و خواستار رسیدگی به تطابق آنها با قانون اساسی در دیوان قانون اساسی جمهوری ترکیه شد، دولت معتقد است فرمان های اضطراری در دیوان قانون اساسی قابل رسیدگی نمی باشند.

1) مجلس جمهوری عربی مصر قانون جدیدی برای ساخت کلیساها جهت برای حمایت از اقلیت های مسیحی این کشور تصویب نمود.

2) اعضای مجلس نمایندگان جمهوری فدراتیو برزیل با اکثریت آرا ادورادو کونیا، رئیس سابق این مجلس را با 450 رای موافق 10 رای مخالف و 9 رای ممتنع به خاطر داشتن یک حساب بانکی سری در سوئیس متخلف تشخیص داده و وی را از نمایندگی برکنار نمودند. وی مدت هاست که با اتهام فساد مالی و دریافت میلیون‌ها دلار رشوه مواجه است و در ماه مه سال میلادی جاری سمت ریاست مجلس نمایندگان را از دست داده بود. ادواردو کونیا یکی از طرفداران برکناری دیلما روسف رئیس جمهور استیضاح شده برزیل است، که در زمان استعفای خود علت آن را افزایش حملات مخالفان تعلیق روسف اعلام کرد. این سیاستمدار محافظه کار تا کنون کرسی مجلس را حفظ کرده بود که او را از تعقیب قضایی و محاکمه احتمالی در امان نگه می داشت.

روز چهارشنبه 31 اوت (دهم شهریور) هم مجلس سنا دیلما روسف، رئیس جمهوری را به اتهام فساد مالی از مقام خود برکنار کرد؛ بیش از دو سوم نمایندگان مجلس سنا با رای مثبت به عدم کفایت روسف، او را که دور دوم ریاست جمهوری خود را از سال 2014 آغاز کرده بود، برکنار کردند؛ میشل تامر، معاون خانم روسف، تا پایان این دوره ریاست جمهوری (2019) ریاست دولت را بر عهده گرفته است.

1-تازه های بین المللی حقوق اساسی:

1) احزاب مخالف دولت جمهوری دموکراتیک کنگو با اعلام اعتراض و برگزاری تظاهرات خواستار احترام رئیس جمهور(Joseph Kabila) به ممنوعیت انتخاب مجدد برآمده از قانون اساسی و عدم نامزدی وی با اتمام دوره ریاست جمهوری شدند. 

2) نخست وزیر جمهوری سنگاپور اعلام کرد بدنبال بازنگری در قانون اساسی این کشور است تا گروه های اقلیت بتوانند بصورت دوره ای به ریاست جمهوری این کشور برسند.

3) دیوان قانون اساسی جمهوری کلمبیا، یکی از قضات خود را که در رسوایی های دریافت رشوه متهم گردیده بود را جهت رسیدگی قضایی و شفافیت خلع مصونیت کرد. در پی توافق صلح با دولت جمهوری کلمبیا، نیروهای مسلح انقلابی کلمبیا(FARC) اعلام آتش بس دائمی نمود.

4) دیوان قانون اساسی جمهوری زامبیا در بیانیه ای اعلام کرد که این دادگاه فضای لازم برای نگهداری و بازشماری آرای انتخابات ریاست جمهوری را ندارد، حزب مخالف رئیس جمهوری کنونی این کشور با ادعای تقلب در انتخابات از این دادگاه درخواست بازشماری آرا را نموده است، در همین حال افتتاح دولت و کابینه جدید نیز با این درخواست به تعلیق افتاده است. 

5)  دیوان قانون اساسی جمهوری آفریقای جنوبی به دولت و قوه قانونگذار این کشور هشدار داد تا از اتلاف وقت از طریق اصلاح قوانینی که مخالف قانون اساسی اعلام شده اند، خودداری نمایند. 

6) دیوان قانون اساسی جمهوری اندونزی به بررسی درخواستی خواهد پرداخت که در صورت رای موافق این دیوان، قانونگذاران محلی در دوره رقابت های انتخاباتی باید از مسئولیت های خود کناره گیری نمایند. 

7)  دیوان عالی جمهوری هندوراس، ممنوعیت انتخاب مجدد ریاست جمهوری در قانون اساسی را لغو کرد. 

8)  دیوان عالی جمهوری آرژانتین، دستور توقف اصلاحات اقتصادی دولتی را بدلیل عدم مشورت عمومی(دولت با عموم مردم) صادر نمود. 

9) دیوان قانون اساسی جمهوری پرو به دولت این کشور دستور داد قرص های پیشگیری از بارداری را بصورت ملی و رایگان در سطح کشور توزیع نماید. پیش از این در سال 2009، این دادگاه در رسیدگی ها خود دسترسی به داروهای اضطراری پیشگیری از بارداری در سیستم بهداشتی این کشور را ممنوع کرده بود. 

10) رقبای انتخاباتی رئیس جمهوری زامبیا (Edgar Lungu) از دیوان قانون اساسی این کشور درخواست بازشماری آرای انتخابات را کردند، ایشان نیازمند 200.000  رای برای پیروزی بر رئیس جمهوری کنونی هستند.

11)  سنای جمهوری کنیا نتوانست لایحه برابری تعداد نمایندگان زن و مرد مجلس این کشور را بتصویب برساند. 

12)  بالاترین دادگاه اداری در جمهوری فرانسه(شورای دولتی)، با استدلال اینکه استفاده از بورکینی(burkini) "خطری اثبات شده برای نظم عمومی" نمی باشد و در نتیجه "نوعی از آزادی است  که نمی تواند محدود گردد" ممنوعیت استفاده از آن در سواحل فرانسه را لغو نمود. نیکلا سارکوزی رئیس جمهور پیشین و نامزد احتمالی این مقام در تبلیغات اخیر خود اعلام کرده است در صورت پیروزی، با بازنگری در قانون اساسی، ممنوعیت استفاده از بورکینی را مجددا اعمال خواهد کرد. 

13)   مجلس سنای جمهوری فدراتیو برزیل با نصاب 61 موافق بر 20 مخالف به استیضاح دیلما روسف(Dilma Rousseff) و خلع وی از مقام ریاست جمهوری بدلیل تغییر بودجه فدرال برای منافع سیاسی رای داد.

14) دیوان قانون اساسی جمهوری عربی مصر در ماه آتی به قانونی بودن مقرراتی که از برگزارکنندگان اعتراضات می خواهد تا سه روز پیش از برگزاری اعتراضات، دولت را از این موضوع آگاه نمایند،رسیدگی می کند؛ منتقدین این محدودیت ها را تلاش دولت نظامی برای سرکوب مخالفان ارزیابی می کنند.

تازه های بین المللی حقوق اساسی:

1) در حالیکه جمهوری کره(جنوبی)، سال 2017 وارد سی امین سالگرد  قانون اساسی کنونی خود خواهد شد، سخنگوی مجلس ملی این کشور بر خلاف نظر رئیس جمهور، خواستار اصلاح نظام ریاست جمهوری و دوره پنج ساله آن گردید.

2) دیوان قانون اساسی رومانی با رد درخواست عدم تعقیب مسئولین دولت، ضمن گسترش مفهوم جرم، اجازه تعقیب بسیاری از دولتمردان را به اتهام  سوءاستفاده از قدرت و نه اتهام های مشابه مانند عدم کفایت صادر کرد.

3) نهاد سازمان ملل متحد برای برابری جنسیتی و قدرت بخشیدن به زنان (UN Women)، با استخراج اصول قوانین اساسی مربوط به زنان از 195 کشور جهان، پایگاه اطلاعاتی حقوق اساسی برابری جنسیتی جهانی GECG) Global Gender Equality Constitutional Database) را برای استفاده پژوهشگران فراهم نمود.

4) پارلمان دولت کویت قانونی را تصویب کرد که بر اساس آن، شرکت در انتخابات برای هر کسی که به "ذات الهی یا انبیاء یا ساحت امیر" خدشه وارد کند، ممنوع است.

1- تازه های بین المللی اخبارحقوق اساسی:

1) دیوید کامرون، نخست وزیر بریتانیا، سوم تیرماه (23 ژوئن) سال جاری میلادی را به عنوان تاریخ برگزاری همه پرسی ترک اتحادیه اروپا یا ماندن در آن اعلام کرد؛  وی این همه پرسی را یکی از بزرگترین تصمیمات دوران زندگی برای نسل کنونی بریتانیا توصیف کرد.

2) حزب نظامیان پادشاهی تایلند، از کمیته تهیه پیشنویس قانون اساسی خواست تا قدرت و مصونیت نظامیان را بدلایلی همچون محافظت بیشتر از کشور، افزایش دهند.

3) با ادامه تحقیقات اتحادیه اروپا در خصوص نقض سیاست های آن اتحادیه در جمهوری لهستان، نماینده ارشد شورا، اعلام نمود پیرو تغییرات قانونی اخیر که تحت فشار دولت لهستان به وقوع پیوسته است، دیوان قانون اساسی آن کشور توانایی خود را از دست داده و این وضعیت موجب تهدید حاکمیت قانون و حقوق بشر در این کشور گردیده است.
